Se la Lega cambia nome “non potremo più riprendere i 49 milioni”. Lo ha spiegato il procuratore capo di Genova, Francesco Cozzi, al Corriere della Sera. “Dinanzi a un nuovo soggetto giuridico – ha detto – non potremo fare nulla rispetto ai versamenti futuri”.
È attesa per la prossima settimana la decisione del tribunale del Riesame sul sequestro dei fondi della Lega. L’udienza è fissata per mercoledì 5 settembre, dopo il rinvio da parte della corte di Cassazione che a aprile ha dato ragione alla procura di Genova che aveva chiesto di poter procedere al sequestro a tappeto su conti correnti e depositi riferibili al partito di Matteo Salvini fino a raggiungere i 49 milioni di euro, provento della presunta truffa allo Stato per la quale è stato condannato in primo grado l’ex leader leghista Umberto Bossi insieme all’ex tesoriere Francesco Belsito.
I giudici del Riesame possono accogliere dunque la decisione della Cassazione oppure respingerla. Nel caso in cui i giudici decidessero per il via libera i legali della Lega potrebbero impugnare davanti agli Ermellini facendo valere tra l’altro la sentenza emessa a giugno dalla Grande Camera della Corte Edu per la vicenda di punta Perotti. Un altro problema sorge sulla esecutività del provvedimento del Riesame: una parte della giurisprudenza lo ritiene immediatamente esecutivo mentre altra parte no.
A inizio luglio la Cassazione aveva depositato le motivazioni secondo le quali la Gdf può procedere al blocco dei conti della Lega in forza del decreto di sequestro, emesso ormai un anno fa, senza necessità di un nuovo provvedimento per eventuali somme trovate su conti in momenti successivi al decreto.
Infatti soldi sui conti potrebbero non essere stati trovati al momento del decreto “per una impossibilità transitoria o reversibile”, e il pm non deve dare conto di tutte le attività di indagine svolte “altrimenti la funzione cautelare del sequestro potrebbe essere facilmente elusa durante il tempo occorrente per il loro compimento”.
Ma di fronte a un nuovo soggetto giuridico completamente autonomo, avverte il procuratore Cozzi, non ci potrà essere alcun sequestro. Questo vale, osserva il procuratore, “anche se il neonato partito è erede del precedente dal punto di vista ideologico e politico”. “Bisogna sempre valutare la continuità giuridica per procedere e in questo caso salterebbe”. Quindi, “si procederà con i sequestri fino a quando ci saranno somme disponibili sui conti della Lega”.
