Rodolfo Fiesoli, il fondatore del “Il Forteto” – una comunità agricola dove per anni, a partire dal 1978, si sono consumate violenze e aberrazioni ai danni di minori, disabili e adulti e al centro di varie inchieste per maltrattamenti e violenza sessuale – è stato scarcerato dopo una decisione della Cassazione che risale al 5 luglio 2018.
Fiesoli era stato condannato a 15 anni e 10 mesi, ma la Cassazione aveva stabilito che dovesse scontare un residuo di pena di 14 anni, 8 mesi e 17 giorni.
Il suo difensore, l’avvocato Lorenzo Zilletti, aveva presentato ricorso per per “incidente di esecuzione’”, inizialmente respinto. Contro questa decisione della corte di appello, allora, i difensori hanno proposto un altro ricorso in Cassazione su cui c’è stata udienza il 5 luglio.
Come ricordano gli avvocati a Repubblica, “La vicenda processuale di Fiesoli non è ancora conclusa perché dovrà celebrarsi un giudizio di rinvio a seguito di alcuni annullamenti pronunciati dalla Corte Suprema il 22 dicembre 2017”.
“In questo contesto – concludono gli avvocati – la Cassazione ha stabilito che Fiesoli va considerato ancora un imputato e non un condannato con sentenza definitiva. Egli quindi non avrebbe dovuto trascorrere in carcere questi sei mesi e mezzo”.
